By accessing or using Bemura ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you and Bemura.
You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement and that all registration information you provide is truthful and accurate. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
Bemura provides AI-powered resume optimisation, cover letter generation, ATS (Applicant Tracking System) scoring, application tracking, and job discovery tools. The Service uses third-party AI (Anthropic Claude) to process your content and generate suggestions. Features may be added, modified, or removed at our discretion.
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality and security of your account credentials, including your password and any two-factor authentication methods. You must not share your account with others. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.
Certain features of the Service may require a paid subscription. Payment processing is handled by Stripe.
You agree not to:
You are responsible for reviewing all AI-generated content before use. AI suggestions are tools to assist you, not replacements for your own judgement.
The Service uses AI to generate resume suggestions, cover letters, ATS improvement recommendations, and other content. You acknowledge and agree that:
Your content: you retain full ownership of all content you submit to the Service, including resumes, cover letters, job descriptions, and application data. By using the Service, you grant us a limited licence to process your content solely for the purpose of providing the Service to you.
Our content: the Service's interface, design, branding, code, documentation, and underlying technology are owned by Bemura and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
If you provide feedback or suggestions about the Service, we may use them without obligation to you.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Key points:
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to:
We do not offer a formal Service Level Agreement (SLA) at this time. We will make reasonable efforts to notify users of planned downtime in advance.
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Bemura and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of revenue, loss of data, inaccurate AI suggestions, missed job opportunities, or service interruptions.
Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) £100.
Nothing in these terms excludes or limits liability for: (i) death or personal injury caused by negligence, (ii) fraud or fraudulent misrepresentation, or (iii) any other liability that cannot be excluded or limited under applicable law.
You agree to indemnify and hold harmless Bemura from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) your violation of these terms, (c) content you submit through the Service, or (d) your violation of any third party's rights.
We may suspend or terminate your account if you materially violate these terms, use the Service in a manner that could damage or impair it, or if required by law. Where possible, we will provide notice before termination.
You may delete your account at any time through the Settings page, which will permanently remove all your data. If you have an active subscription, cancellation of billing is separate from account deletion — cancel your subscription first to avoid further charges.
Upon termination, your right to use the Service ceases immediately. We may retain anonymised, aggregated data that does not identify you. Sections of these terms that by their nature should survive termination will remain in effect (including Limitation of Liability, Indemnification, and Governing Law).
We may update these terms from time to time. Material changes will be communicated via email or a prominent notice within the Service at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance. If you disagree with the updated terms, you should stop using the Service and delete your account.
These terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
Any dispute arising from these terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer in the European Union, you may also bring proceedings in the courts of your country of residence. Nothing in these terms affects your statutory rights as a consumer under applicable EU or UK law.
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision does not constitute a waiver. These terms, together with the Privacy Policy, constitute the entire agreement between you and Bemura regarding the Service.
If you have questions about these terms, please email [DATA_PROTECTION_EMAIL].
